According to Yarovaya's law: impact on the telecom market


For the telecommunications and Internet industry, the main problem at present is the implementation of the requirements of the Yarovaya Law. The document, adopted in 2016, should come into full force in the near future, but the regulations for it are not yet ready. The implementation of the requirements of the law "head-on" can lead to trillions in costs for market participants and make their business unprofitable.

The bill introduced similar requirements for "organizers of information dissemination on the Internet" (ORI). This term was introduced two years earlier by another "anti-terrorist" package of bills, co-authored by deputy Irina Yarovaya. ORI refers to any website or service on the Internet that allows users to communicate, except for websites for personal and family needs. ORI, according to the law adopted in 2014, were required to register in a special Roskomnadzor Registry, store all data on subscriber correspondence on Russian territory for six months, and transfer this information to law enforcement agencies.

Following protests from the telecommunications and Internet industry, the bill was amended in the second reading. Operators were required to store the contents of users' correspondence for up to six months, and ORIs were required to store metadata about the correspondence for one year. Moreover, the entry into force of the norm on storing the contents of messages was postponed until July 1, 2018.

During the second reading, a new requirement was introduced to the ORI. In the event that the service uses end-to-end encryption technology (encryption of messages by exchanging keys between the users themselves), the keys for decrypting such messages must be transferred to law enforcement agencies.

Telecom operators sounded the alarm, warning that the proposed law would make their business unprofitable, stop the investment program and the introduction of new technologies, including the widely discussed fifth generation of cellular communications (5G). They also talked about increasing tariffs for subscribers. However, Russian President Vladimir Putin signed the law anyway, simultaneously giving a number of instructions to executive authorities. In particular, the Ministry of Communications and the Ministry of Industry and Trade were instructed to develop proposals for implementing the requirements of the Yarovaya Law based on domestic equipment.
