What is the Omnibus Directive?
The Omnibus Directive is a new regulation that aims to solve certain irregularities or unwanted practices created by online stores. It was adopted on November 27, 2019 and aims to protect consumer rights. The introduction of the Omnibus Directive is to solve the problem of:

simplifying the structure of information obligations that burden the entrepreneur.
In Poland, the directive entered into force on 1 January 2023. Since then, it has been binding on all Polish entrepreneurs with online stores (e.g. those with online stores on WooCommerce, Shopper or others).

Penalties for violating the Omnibus Directive
The EU project also provides for penalties for online stores failing to comply with the new regulations. After finding irregularities, the provincial inspector of the Trade Inspection may impose a fine of up to PLN 20,000 on the entrepreneur.

It is worth adding that the penalty increases in the case of repeated abuses even to PLN 40,000. It is also possible to receive a penalty of 10% of the annual turnover of a given entrepreneur. Such a penalty can be imposed in the case of extreme cases of violating the collective interests of consumers.
